In 1999, the Florida Legislature, with bipartisan support, enacted the A+OSP proposal of Governor Jeb Bush. In that same year, the Legislature and Governor approved the McKay Scholarships Program for Children with Disabilities as a pilot project in Sarasota County. In 2000, they expanded the McKay Scholarships Program statewide.
In the 2001 session, the legislature passed the Corporate Income Tax Credit law creating scholarships for low-income children. See Education Tax Credits and Deductions for a description. Also in the 2001 session, various provisions that had proved limiting to the families or the schools were removed from the McKay program and it formally was renamed the John M. McKay Scholarships for Children with Disabilities Program in recognition of the Senate President who had championed it from the start.
On January 5, 2006, the A+ Opportunity Scholarship Program was declared unconstitutional by the Florida Supreme Court.
