Colorado Opportunity Contract Pilot Program

On April 16, 2003, Colorado Gov. Bill Owens signed into law the Colorado Opportunity Contract Pilot Program, making Colorado the first state to pass voucher legislation since the U.S. Supreme Court confirmed the constitutionality of such programs in June 2002. A Colorado judge ruled in June that the state’s voucher program is unconstitutional because it strips local school boards of control over education.

The program would have applied to any Colorado district with eight or more schools that rated poorly under the state accountability system. Eleven school districts, including Denver and Colorado Springs, were considered eligible. Other school districts could have participated voluntarily by school board vote.

The program would have applied to children in kindergarten through 12th grade who were eligible for free or reduced-price school lunches.
